Page 385 Brook County, Virginia This indenture made this 1st day of February 1828 be- tween Andrew Foster and Nancy his wife of the coun= ty of Muskingum in the State of Ohio of the one part and Benjamin Foster of the County of Brooke in the state of Virginia of the other part Witnesseth that the said Andrew Foster and Nancy his wife for and in consideration of the sum of one hundred and fifty dollars to them in hand paid by the said Benjamin Foster at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain sell alien convey and confirm unto the said Benjamin Foster his heirs and assigns forever all the interest right title claim and demand at law and in equity of them the said Andrew Foster and Nancy his wife of in and to a certain tract or parcel of land situate lying and being in the County of Brooke aforesaid supposed to contain 244 acres by the same more or less bounded on the North by lands of Walter Cain on the east by the lands of the same on the south by land of Eli Green and on the west by lands of Nicholas Worthington To have and to hold the interest and claim of them the said Andrew Foster and Nancy his wife either in lieu or equity of in and to the said tract or parcel of land to the said Benjamin Foster his heirs and assigns forever to the only proper use and behoof of him the said B Foster his heirs and assigns forever and the said Andrew Foster and Nancy his wife for themselves and their heirs do hereby covenant promise and agree to and with the said Benjamin Foster his heirs and assigns that they the said Andrew Foster and Nancy his wife the interest hereby granted to the said Benjamin Foster his heirs and assigns forever will warrant and defend against all persons whatsoever.
