Virginia; Witnesseth that the said Elijah McMillan for and in consideration of one dollar to him in hand paid, doth bargain and sell unto the said Abram Mongle and heirs the following property to wit: one gray mare, saddle & bridle, 3 bedsteads & furniture, one bureau, one table & all my household furniture, 2 axes & 2 hammers to have and hold said property unto said Abram Mongle and his heirs against the claims of all persons whomsoever--in trust; neverless, that if the said ELIJAH or his heirs shall on or before the 12th day of October 1841, will and truly pay or cause to be paid unto J.C. & D.C. CUMMINGS the full and just sum of Ten dollars & eighty-five due Oct. 1st 1840, and $42.84 to Joshua BORDWINE due the same, which is justly die them together, with the expense of drawing and recording this indenture, then this indenture to be void and in further trust, that if said Elijah McMillan or his heirs shall fail to pay the said sums, on or before the 12th day of October 1841, then it shall be lawful for the said Abram MONGLE or his heirs, executors or administrators to proceed to sell the above property at public sale to the highest bidders for ready money, having advertised the time & place of sale for 10 days, by putting up an advertisement for that purpose at the front door of the Washington Co. courthouse, and out of the proceeds to pay both Bordwine & Cummings whatever may be due them and 6 percent to said trustee for his trouble, and the overplus, if any to said Elijah McMillan, or his heirs.
