PATRICK COUNTY, VA - COURT - Order Book "3" (Selected Entries, 1825) ----¤¤¤---- JANUARY COURT (13 January 1825) Ordered that the declaration on application of John Fry for a pension under the provisions of the act of Congress passed in 1818 for the poor & Indigent soldiers of the revolution with the appended Testimony be Certified to the department of War. John Clark senr. is appointed surveyor of the road in place C. Ziglar resigned & it is ordered that the list of the hands filed be his gang. Administration of the estate of the estate of John Camron decd. with the will annexed by Consent of the Heir at Will is granted to Thomas Penn whereupon he entered into and acknowledged a bond Conditioned according to law in the penalty of one hundred dollars. Ordered that the acct. of Wm. Lyon Deputy sheriff of this County for $4.20 Cents be allowed & Certified to the Auditor of public accounts. John Lyon is superseeded in his appointment of surveyor of the road by the appointment of Solomon Clay, & it is ordered that the list of the hands filed be his gang. FEBRUARY COURT (17 February 1825) Present: Harvey Fitzgerald, George Carter, Hardin Hairston & Joseph Kennarly -- Gentlemen Justices A deed from Nancy Packwood Executrix of S. Packwood decd. to Charles Smith with the Certificate thereon endorsed was exhibited in Court, Examined and Ordered to be recorded. Administration of the estate of Benjamin Philpott decd. is granted to Abraham Staples, Greensville Penn, and Hardin Hairston, whereupon after being duly qualified they entered into and acknowledged a bond conditioned according to Law. A deed of trust from Saml. McAlexander & James Tuggle to John McAlexander acknowledged & ordered to be recorded. An account Current of the estate of Samuel Hicks decd. returned into Court, Examined & ordered to be recorded. Administration of the estate of Wm. Keaton senr. decd. is granted to William Keaton Jr. who after being duly qualified entered into & acknowledged a bond conditioned according to Law. William Crum, John Sharp Jr. & William Elliott are appointed Commissioners to appraise the estate of John Camron decd. & thereupon report to Court. MARCH COURT (17 March 1825) Harvey Fitzgerald, James Nowlin & George Carter or any two of them are appointed Commissioners to appraise the estate of Benjamin Philpott decd. & report to Court accordingly. Also a deed from John McAlexander to Edmund McAlexander acknowledged and ordered to be recorded. (18 March 1825) Maynor v. Sharp dismissed for want security for Costs. Moore & Co. v. Philpott abates by Defendant's death since the last Continuance of this Cause the said defendant has died. Upon the petition of Ela Belsey (?) Bainsted, it appearing to the satisfaction of the Court that she has received personal Violence at the hands of Tho. Jefferson Jarvice & that she is a poor person & unable to defray the charges of a suit, it is ordered that she have leave to institute a suit agt. the said Tho. J. Jarvice in forma pauperis. APRIL COURT (14 April 1825) An Inventory of the estate of Benjamin Philpott decd. was returned in to Court by A. Staples one of the administrators thereof, examined and ordered to be recorded. Upon the production of the sheriff of Patrick recept for $16 to Christopher G. Babcock a License is granted him to sell by retail goods and merchandize of foreign growth & manufacture in the said County of Patrick for the term of one year. Ordered that Jefferson Taylor be allowed to act in Richard Hopkins bounds as Constable and the said Hopkins is allowed to act in the said Taylors bounds.... MAY COURT (12 May 1825) Thomas Harbour, Charles Smith, Charles Foster, Jesse Reynolds, Wm. Critz & George Carter each appeared in Court & were qualified as overseers of the poor in this County according to Law. Hancock for benefit of S. ..? v. Lyon deputy for J. Hall, on a motion dismissed for want of prosecution and defendants costs awarded him & Jud. accordingly. Thompson for benefit of Tuggle v. Hall sheriff on a motion dismissed for want of prosecution and defendants costs awarded him & Jud. accordingly. On the motion of William Lyon for leave to erect a gr. mill on his own land in this County, the same for reasons appearing to the Court is granted him. JUNE COURT (16 June 1825) John Burnett is allowed one days attendance as a witness for Burnett ads Hill. Clarks v. Thomas Sharp, Wm. Crum & Peter Critz on a delivery bond Nolue proved and Judgment according to specialty & Costs with award of Execution. To James Hopkins as surveyor of a road for 4 days services $2.00 To Edward Thomas as ditto for 5 days services 2.50 To Christopher Foley as ditto for 6 days " 3.00 To Hamon Critz as surveyor of the road 2 days 1.00 To Francis Nowlin as ditto 1 day .50 To John Lyon as surveyor of the road 2 days 1.00 To William Morris as ditto for 8 days services 4.00 To William Sharp as ditto for 3 days 1.50 To Silas Carter as ditto for 6 days 3.00 (17 June 1825) Jane Lyon is allowed one days attendance & travelling 9 miles as a witness for Smith v. Smith admr. To John Sharp surveyor of the road for 4 days $2.00 To Samuel Flippin as ditto for 3 days 1.50 To Notley Adams as surveyor of the road for 2 days 1.00 To Cornelious Keaton as surveyor 3 days 1.50 JULY COURT (14 July 1825) John Stone is appointed Curator for Micajah Stone, who is now in the custody of the jailor of this County upon a charge of Murder, whereupon he entered into and acknowledged a bond Conditioned accounding to Law with good & sufficient security. Warren Massey, John Parker, John Akers, Myrtle Lesurer and Aaron ..? or any three of them are appointed Commissioners to lay off and allot to Martha Stone widow of Richard Stone decd. her one third part of the Lands & personal property of which her Husband decd. died seized and thereupon report to Court as soon as Completed. William Lyon, Samuel Harriss, Shadrack Turner & Nathan Hall or any three of them are appointed Commissioners to View away for Turning the road from near Saml. Harrisss shop to intersect with the old road in the north end of the old field near N. Halls & when done to report to Court. SEPTEMBER COURT (15 September 1825) Ordered that Samuel Rakes with his gang and James Brammer and his gang be appointed to cut & open a road from Charity meeting House into the road upon the Hill near Costello Hills and it is further ordered that John Hall be appointed to superintend the same, & that as soon as the said opening is Completed to return to their respective roads again. OCTOBER COURT (13 October 1825) To John McAlexander Guard(?) as per acct $1.04 To John Lackey as per ditto 1.04 To Nathan Nelson as per ditto 1.04 To Alexander McAlexander as per ditto 1.04 To William Crum Constable as per acct. 7.14 To Jefferson Taylor Constable as per ditto 1.04 John G. Lee is appointed Constable in place of Wm. Crum resigned whereupon he entered into and acknowledged a Bond Conditioned according to Law after having taken the several oaths prescribed by Law for Constables. Wm. Lyon is allowed allowed 2 days attendance as a witness for Ayres ads Penn. James Harriss Smiths river is exempted from paying County & parish Levies for the future. NOVEMBER COURT (17 November 1825) A deed from William Hancock to William Lyon acknowledged in open Court and ordered to be recorded. (18 November 1825) A deed from Samuel McAlexander & John McAlexander to William McAlexander with the Certificates of acknowledgement by the said Samuel & John McAlexander before two of the Commonwealths Justices of the peace of this County & the Certificate of the relinquishment of the right of dower by the wife of the said S. McAlexander before the same Justices was exhibited in Open Court, examined & ordered to be recorded. To William Lyon sheriff of this County as per acct. $4.63 To same as per ditto 5.04 Mathew Sandifur is allowed one days attendance as a witness for Burnett ads Hill. John Houchings is allowed one days attendance as a witness for Sneed v. Hill. DECEMBER COURT (15 December 1825) Lyon v. J. Massey on an attachment for rent Judgment granted the plaintiff for the sum of $15.52 with Interest etc. & the Costs especified in the prosecution of said attachment & it is further ordered & decreed that the said property upon which said attachment is Levied be sold forthwith according to Law by the sheriff in satisfaction of said Judgment. On the motion of John Barksdale, it is ordered that Richard Thomas, Charles Thomas Jr., Adam Turner, Joseph Kennerly, John Hall, and William Crum or any three of them be appointed commissioners to View away for a road from David Crews by Hairstons new forge into the road near Hairstons store and thereupon when Completed report the same to Court without delay. On the motion of Meekins Reynolds, ordered that William Elliott, John G. Lee, Joshua Adams, and William Crum or any three of them be appointed Commissioners to View away for changing the road leading from his place to Moses Reynolds so as to make the road of expedient....? on the left side of said Meekins Reynolds instead of the right side & thereupon make report to Court. Richard Hopkins Constable appeared in Court & resigned, whereupon the Court appointed in place William A.
