A-C1823-1844; [item 1] Volume A Years 1823-1832 Pages 195-197; Family History Library, Salt Lake City, Utah Written: January 12 1829 Recorded: February 11 1829 I Simeon MOTT of the town of Rose and county of Wayne and state of New York do make and ordain this my last will and testament in manner and form following, viz, I give and bequeath to my daughter Mary Ann BICKFORD, the sum of five dollars, I give and bequeath to my daughter Loas McNAB the sum of five dollars, I give and bequeath to my son Stephen W MOTT the sum of five dollars I give and bequeath to my daughter Anna TITUS the sum of five dollars all to be paid in ten years from the date of this I give and bequeath to my daughters Hannah MOTT and Gerusha MOTT, fifty acres of land in the town of Rose and county of Wayne and State of New York on which I now live to be equeal shares and to have possession after their mothers death, all the rest and residue of my estate goods and chattels I give and bequeath to my beloved wife Anna MOTT, togeather with the use of the land (bequeathed to my daughters Hannah MOTT and Gerusha MOTT) her life time whom I now nominate constitute and appoint sole executrix of this my last will and testament hereby revoking all others and former wills by me at any time heretofore made_ In witness whereof I have hereunto set my hand and seal the twelvth day of January in the year of our Lord one thousand eight hundred and twenty nine Simeon (his mark) MOTT {seal} Signed sealed published and declared by the said testator Simeon MOTT as and for his last will and testament in the presence of us who have subscribed our names and witnesses thereto in the in the [sic] presence of the said testator Chauncey BISHOP Prentice J MINER Griffin (his mark) WARREN Wayne County, ss. Be it remembered that on the eleventh day of February in the year of our Lord one thousand eight hundred and twenty nine personally appeared before me Graham H. CHAPIN Esquire Surrogate of the county of Wayne Prentice J. MINER who being duly Sworn did depose and say, that he deponent saw Simeon MOTT late of the county of Wayne, deceased, sign and seal the written Instrument then shown unto him of which the aforegoing is a true copy, purporting to be the last will and testament of the said Simeon MOTT deceased, bearing date the twelfth day of January in the year of our Lord one thousand eight hundred and twenty nine. That at the time thereof, the said Simeon MOTT was of a sound disposing mind and memory, to the best of the knowledge and belief of him the said deponent and that he the said deponent and Chauncy BISHOP and Griffen WARREN subscribed their names as Witnesses to the said Will in the presence of each other and in the presence of the testator. To all to whom these presents shall come or may concern send Greeting: Know ye, that at the town of Lyons in the county Wayne on the eleventh day of February in the year one thousand eight hundred and twenty nine before Graham H. CHAPIN Esquire, Surrogate of our said county, the last will and testament of Simeon MOTT, deceased, (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by as; and the said deceased having whilst he lived and at the time of his death, goods chattels or credits within the state, by means whereof the proving and registering the said will, and the granting administration of all and singular the said goods, chattels and credits, and also the auditing, allowing, and final discharging the account thereof doth belong unto us:_ the administration of all and singular the goods, chattels and credits of the said deceased and any way concerning his will is granted unto Anna MOTT executrix in the said will named hereby requiring you will and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the goods chattels and credits and also to under a just and true account thereof when thereunto required_ In witness whereof, we have caused the seal of office of our said surrogate to be hereunto affixed.
