I Isaac Rhodes of said town of Plattekill considering the uncertainty of time and being of sound mind and memory do make declare this my last will and testament in manner and form following: First, I wish and require my executor to pay all my lawful debts and funeral expenses, to sell and dispose of all of my real estate his [sic] partly in the town of Plattekill & Marlborough at such time and manner as he may consider to the best advantage for all parties concerned and after paying the said or above debts & expenses and deducting his own expenses in setting up my estate, I give and bequeath whatever sum may be left of my estate to my sister - Hester Warren wife of James Warren. I hereby appoint Jonathan Caverly to be sole executor of this my last will and testament In witness whereof I have hereunto set my hand and seal this eight day of May in the year of our Lord one thousand eight hundred and seventy five. his Isaac X Rhodes L.S. mark The above instrument consisting of one sheet was now hereby subscribed by Isaac Rhodes the testator in the presence of each of us, and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witnesses. LS: William Carpenter & Lewis G Rhoads of the town of Marlborough Ulster Co. being first duly affirmed in open Court, on their oaths depose and say that they are subscribing witnesses to the last will and testament of Isaac Rhoades late of the town of Plattekill in the County of Ulster deceased: and these deponents further say, that the said deceased did in the presence of these deponents subscribe his name at the end of the instrument which is now here shown these deponents, and which purports to be the last will and testament of the said deceased, and which bears date the 8-day of May in the year one thousand eight hundred and Seventy-five: that the said deceased did, at the time of subscribing his name to the same instrument as aforesaid, declare the same to be his last will and testament: that these deponents did thereupon subscribe their own names at the end of the said instrument, as attesting witnesses to the execution thereof, at the request of the said deceased, and in his presence and in the presence of each other: and that the said deceased at the time of subscribing his name to the said instrument as aforesaid, was upwards of twenty one years of age, that he appeared to be of sound mind and memory, and was not under restraint to the knowledge and belief of these deponents.
