DEAN Town of Annsville Probate: 17 December 1856 At a Surrogates Court held at the Surrogate Office in Utica, in the County of Oneida, on the 17th day of December AD, 1836, before Henry M. Burchard, Esq., Surrogate of the said county, for the purpose of proving afnd recording the last will and testament of Joseph E. Dean, late of the Town of Annsville, in the County of Oneida, deceased, in pursuance of Chapter Sixth ___ first article, first part second of the Revised Statutes of the State of New York and of an Act entitled “An act concerning the proof of Wills, Exzecutors and Administrators, Guardians and Wards, and Surrates Courts,” passed May 16, 1834 and other Acts concerning the sums per the application of Harrison Lillybridge in said will named one of the Executors. Hannah Dean, a witness, produced and sworn in open court being duly sworn says that she is a resident of Annsville in said County of Oneida, that she was well acquainted with Joseph E. Dean, deceased, and had been ten years previous to his death, that he died at Green Bay in the County of Brown and State of Wisconsin, in the month of September, last past, but Annsville, Oneida County, New York, was his place of residence at the time of his death. Deponent further says that she was present at the execution of the last will and testament of the said Joseph E. Dean, deceased, that she saw him sign the paper here offered to be publshed, recorded and admitted for probate as the last will and testament of the said Joseph E. Dean deceased, on the day and the day it bears date. That she saw John M. Smith, Emily R. Smith, and E. Holins Ellis severally sign said will as attesting witnesses in the presence of the testator and in the presence of each other at the request of the testator and that said will was so signed as aftersaid at Green Bay, Wisconsin. And this deponent further says that the said testator,at the time he so signed the said will then and there in the presence of this deponent, and John M. Smith, Emily B. Smith, and E. Holins Ellis, the subscribing witnesses, published and declared the same to be to and for his last will and testament and the deponent further says that she saw the testator at the time he affixed his signature and declared the same as aforesaid was of sound and imposing mind and memory and of full age and not under restraint and competent to _________Real Estate. Signed: Hannah Dean And thereupon the further hearing of the probate of said will was adjourned to the third day of January, 1857 at ten o'clock a.m. at Clinton at which time and place the following deposition was filed by Abiel Dean, the father of said testator. I hereby consent, and request that the last will and testament of Joseph E. Dean, deceased, be admitted to probate by the Surrogate of the County of Oneida, and request the said Surrogate to issue letters testamentary ___________ to Hannah Dean and Harrison Lillybridge, the executrix and executor herein named and that said will be established by the proof taken. DEAN of the City of Green Bay, in the County of Brown and State of Wisconsin. I, Joseph E. Dean of said city and county, being of lawful age and of sound mind and disposing memory and understand, do make and publish this my last will and testament in manner and form following, that is to say: First, I will and direct that the expenses of my funeral and all my just debts be fully paid out of my personal estate, _______ ______ may be after my decease. Secondly, I hereby give, devise, and bequeath unto my beloved wife, Hannah Dean, all the rest and residue of my personal (?) and real estate after payment of debts as aforesaid, of whatever kind or description and wherever the same may be, to have and to hold the same to her during her life. Third. At her death I will and declare (?) __________ the said estate both real and personal be divided and distributed to and among ________heirs at law according to the _______ in such case _____ ____ and I hereby appoint my wife, Hannah Dean, executrix of this my will until her death and Harrison Lillybridge of Annsville, Oneida county, New York, executor ____________. I will and direct that the said Harrison Lillybridge residing in Oneida County, NY, will be executor of this my last will and testament and I hereby revoke all former will made by me to _______________.
