It is a Will from the late Alfred Cary (founder of Caryville) listing James W. Whitman as guarantee: This indenture, made the Twenty first day of July, in the year of our Lord one thousand, eight hundred & fifty nine Between Trumbull Cary & Homer Kimberly, Executors of the last Will & Testament of Alfred Cary, deceased of the first part & James W. Whitman of the Village of Cary, in the Town of Oakfield in the State of New York (County of Genesee) of the second part Witnesseth that the said party of the first part, for & in consideration of the sum of Five hundred & forty four Dollars, to them duly paid by the said party of the second part, the receipt whereof is hereby acknowledged, have, by the power & authority vested in them by the said last Will & Testament, granted, bargained, sold & conveyed & by these presents do grant bargain, sell & convey unto the said party of the second part & to his heirs & assigns forever All that piece or parcel of land called lot number sixteen in the village of Cary, Bounded East by the Westerly bounds of South Street two chains, Southerly by land deeded to William Whitebrook two chains, fifty links. Westerly by land deeded by the said Alfred Cary to Francis P Reeves tow chains & Northerly by land deeded to John Thompson two chains, fifty links, Containing more or less. Together with all & singular the tenements, hereditaments & appurtenances thereunto belonging or in anywise appertaining, and all the estate, right, title, interest, property, papepion (?), chains & demand whatsoever of the said party of the first part of, in, or to the above described premises & every part & parcel thereof with the appurtenances. To have & to hold forever. And the said party of the first part for themselves, their heirs, executors & administrators do covenant, promise & agree to & with the said part of the Second part, his heirs & afsigns that they have not made, done, committed, executed or suffered any act or acts, thing or things whatsoever whereby or by means whereof the above mentioned & described premised or any part or parcel thereof now are or at any time hereafter shall or may be impeached, charged or imcumbered in any manner or way whatsoever.
