All rights reserved. http://www.rootsweb.com/~usgenweb/copyright.htm http://www.rootsweb.com/~usgenweb/ny/nyfiles.htm Submitted Date: February 21, 2006 This file has been created by a form at http://www.genrecords.org/nyfiles/ File size: 6.1 Kb ************************************************ Source: sampubco.com Franklin County, New York Will Book, Volume 8, Page 307 Written: November 20, 1875 Recorded: December 16, 1884 Surrogate Court In the Matter of the Will of Ann Foster, Deceased Be it remembered that heretofore, to wit on the 10th day of Oct. in the Year one thousand eight hundred and eighty four, James Jackson, sole Executor named in the last Will and Testament of Ann Foster, late of the town of Bombay, appeared in open Court before the Surrogate of Franklin County, and made application to have said will, which relates to both Real and personal estate proved and on said application the Surrogate did ascertain who were the heirs at law and next of kin of said deceased and their respective residences and the said Surrogate did thereupon issue a citation under form of law directed to said heirs at law and next of kin by their respective names, stating their respective places of residence, requiring them to appear before said Surrogate at his office in Malone Village on the 16th day of Dec. 1884 at 10 o’clock AM and attend the probate of said will and on that day satisfactory evidence by affidavit was produced and presented to said Surrogate of the service of said citation in the mode prescribed by law and on that day, no one appearing to oppose the probate of said Will, and proceedings were thereupon had afterwards that the Surrogate took the proof of the Will, hereinafter set forth upon the 16th day of Dec. 1884 and he adjudged said Will to be a valid will of Real and personal estate and the proofs thereof to be sufficient which said last Will and Testament and proofs are as follows: Will In the name of God, Amen, I, Ann Foster of the town of Bombay in the County of Franklin and State of New York, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament. That is to say: First. After all my lawful debts are paid and discharged, I give and bequeath unto Thomas Grier & George Grier, my grandsons, all of my real estate, consisting of twenty acres of land, except Thomas and George are to pay Anna Crowley and Mary Jane Grier, their sisters, each one hundred dollars at the time they take possession of said land. I give and bequeath unto Anna Crowley one hundred and thirty-six dollars, the money now in her possession. I give and bequeath unto Mary A Grier the use, rents and profits of the said twenty acres of land until Mary J Grier arrives at the age of twenty-one years. I also give and bequeath unto Mary A Grier the balance of my personal estate of whatsoever name or nature. Likewise I make, constitute and appoint James O Jackson of the town of Bombay, Franklin County, State of New York to be Executor of this, my last will and testament, hereby revoking all former wills by me made. In witness whereof I have herewith subscribed my name and affixed my seal the twentieth day of November in the year of our Lord one thousand eight hundred and seventy five. William D Southwick Town of Bombay Norman H Shannon Hogansburgh Surrogates Court, County of Franklin, New York In the matter of the last Will and Testament of Ann Foster, Deceased Examination of Witnesses produced, sworn and examined in the above entitled Matter, County of Franklin ss: William D Southwick and Norman H Shannon being severally and duly sworn and examined before Horace A Taylor, Surrogate of the County of Franklin on behalf of the applicant to prove said will do each depose and say as follows: We were each well acquainted with Ann Foster, deceased, the subscription of the name of said decedent to the instrument now shown to us and offered for probate as her last Will and Testament and bearing date the 20th day of November in the year of the Lord one thousand eight hundred and seventy five was made by the deceased the residence of the decedent in Bombay in the presence of us and each subscribing witnesses to said instrument at the time of making such subscription the said decedent declared the said instrument so subscribed by her to be her last will and testament and we the undersigned thereupon subscribed our names as witnesses at the end of said instrument at the request of said decedent and in her presence and in the presence of each other. The said decedent at the time of so executing said instrument was upwards of the age of twenty one years and a Citizen of the United States and of sound mind, memory and understanding and not under restraint or in any way incompetent to devise her estate.
