Trowbridge and Elisabeth his wife of the village of Poughkeepsie of the first part and Robert Gipson of the place aforesaid of the second part witnesseth that the said party of the first part in consideration of $1,112.50 duly paid have sold and by these presents do grant and convey to the said party of the second part all that lot of land and premises in the village aforesaid. being part of a lot of land known as the Conklin Lot. Bounded on Mansion mill, Bridge Street, and lands of George C. Marshall and more particularly described on a map the thereof and of other lots made by George Van Vlect civil engineer and filed in Dutchess County clerk's office August 1, 1843. The lot hereby conveyed being known on a said map as Lot 21. Beginning on the south line of Mansion Street and 40 ft. from the center of a large elm tree, at a point on the division line of said lot #21 and lot #22 thence westwardly as the line of Mansion Street now runs. 36 ft. as to the East line of a lot #23 in connection with said line south 21 degrees and 17 minutes west 150 ft. and 8 in. to the dividing line. Thence eastwardly on said line 23 ft. and 6 in. to the East line of the hereby described lot. Thence in the line of said lot and lot #22 about 154 ft. to the place of beginning. With the restrictions and conditions following viz. There shall not be erected on the premises hereby conveyed any brewery, distillery, tannery, slaughterhouse, markethouse, tallow chandlery, fryinghouse for obtaining butter, lard or bones. Nor any leather, soap, glue Corub?, tin or sheet iron factory. Nor any furnace forge or blacksmith shop and that no buildings erected or hereafter to be erected as such a premises shall be used or occupied any of the uses or purposes aforesaid. And also that all and singular the buildings here after to be erected on such premises shall be placed at least nine feet. As and the barns and stables at least 100 ft. from the north line of such premises and the south line of Mansion Street with the appurtenances and all the estate tithe and interest of the said party of the first part therein. And the said Stephen B. Trowbridge does a hereby covenant and agree that at the delivery hereof he is the lawful owner of the premises above granted and leased of a good and indefeasible estate of inheritance therein clear of all encumbrance. Excepting a mortgage heretofore executed by Egbert Townsend and wife to said Stephen B. as Trowbridge by him and subsequently as assigned to William Wilkinson on which a mortgage so assigned there is due and unpaid at date here of the sum of $400. The premises herein described being deeded subject to said incumbrance the amount of thereof being assumed by said Gipson and accepted by said Trowbridge as so much of the consideration aforesaid. And the that he will warrant and defend the above granted premises in the quiet and peaceable possession of the said party of the second part his heirs and assigns forever. In witness whereof the said party of the second part have hereunto set their hands and seals the day and year first above written. Sealed and delivered in the presence of Stephen P. Trowbridge SS. Eliza Trowbridge SS. The written words in all line 7 from Boston canceled prior to execution. Dutchess County SS on the the the 30th day of April in the year 1847 Stephen P. Trowbridge and Eliza his wife to me known to be it the individuals described in and the within conveyance personally came before me and and severally acknowledged that they executed the same. The said Eliza on a private examination by and before me acknowledged that she executed the said a conveyance freely and without any fear or compulsion of her husband. Adolph M.
