First of all I recommend my Body to the Earth to be buried in decent christian Burial at the discretion of my Executors. As touching my Worldly Estate, I give and dispose of the same in the following manner and Form. First I give and bequeath to Frederick Hilligas my son all the Blacksmith Utencils or tools without exception. Secondly I give the said Frederick Two Horses to Chose out of all the Horses which belongs to the Farm. Thirdly, I give said Frederick the Bed, Bed stead two pillows two sheets the blankets or coverleads, two Pillow Cases which goes under the name of being my own Bed, with all his own Cloths or Apparels. I give to my Daughter Elizabeth the Second choice of Two Horses and by these Presents doth give and bequeath the said two Horses to her. It further my Will and Pleasure that the Farm which I now occupy or live on should be sold with all my Valuables or Effects and that Sum Total or whats Left Amount be with the Debts after paying all my Debts, should be divided Twelve Parts or Shares my children and Margaret natural Child to my daughter Cathrine deceased and Wife to John Simmons to share and divide in the following manner. My son Frederick to have four shares or four Twelveth of the Neat. Amount of my property my daughter Elizabeth to have two Shares or Two Twelveth. Christian, John, Margaret natural children of my Daughter Cathrine deceased and Wife to John Simmons Mary and Rebecca and Peter these last six children to have each one one Share or one Twelveth as aforesaid. I Likewise Appoint and air Fite Roshman and Frederick Hilligas my son my Executors of this my last Will and Testament. In Witnefs whereof I have hereunto Set my Hand and Seal the day and year above. COLUMBIA: Be it remembered that on the 23 day of October in the year of our Lord, one thousand eight hundred, James M. Van Duesen of the Town of Claverack in the county of Columbia, farmer personally appeared before me Philip L. Hoffman, surrogate of the county aforesaid and being duly sworn says that he saw Frederick Hilligas sign and seal the within instrument purporting to be his last Will and Testament and hear him publish and declare the same as and for his last Will and Testament that at the time of executing thereof he saw Frederick was of sound disposing mind and memory to the best of the knowledge and belief of the Deporantand that Samuel West, John Anderson, and the Deporant subscribed these names as witnesses to the said Will in the presence of the Testator. Hoffman) COLUMBIA: Be it also remembered that on the said 23 day of October in the said year of our Lord one thousand eight hundred Fite Roshman and Frederick Hilligas, the executors in the said Will name personally appeared before me Philip L. Hoffman, Surrogate of the County of Columbia and were duly qualified, both swear execution and performance of the said Will by taking the oath by law approved. (Signed - Philip L. Hoffman) THE PEOPLE OF THE STATE OF NEW YORK, by the grace of God free and independent to all whom these pursuits shall come or may concern send Greeting KNOW YE that at Livingston on the day of the date hereof before Philip L. Hoffman, Esq, Surrogate of our said county, the last will and testament of Frederick Hilligas deceased, a copy whereis hereunto annexed was inoued and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death, goods, chattels or credits within this state by laws proving and registering the said Will and the granting administration of all and singular the goods, chattels and credits and also the auditing allowing and final discharging the account there with the account belong unto us the administration of all and singular, the goods, chattels and credits of the deceased and any way concerning his Will is granted unto Fite Roshman and Frederick Hilligas the Executors in the said Will, they being first duly sworn to faithfully administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods, chattels and credits and also to render a just and true account thereof when thereunto required. In Testemony whereof we caused the seal of office of our said surrogate be for hereunto Official Witness Philip L. Hoffman Esquire, Surrogate of the said county at Livingston aforesaid the twenty third day of October in the year of our Lord one thousand eight hundred and of our Independence the twentyfith year.
