CUYLER Surrogate proved July 9th 1824 by M TALLMAN In the name of God Amen I, Henry WATKINS of Scipio in the County of Cayuga and State of New York being of sound and perfect mind and memory blessed be Almighty God for the Same do make publish and declare this as my last will and testament herein and hereby revoking all former wills by me made in manner following to wit_ And firstly I do hereby nominate Constitute and appoint Philo SPERRY and Eleazar BURNHAM of Scipio aforesaid Executors and the Survivor of them Executors of this my last will and testament Secondly it is my will and desire that my Said Executors as Soon as may be after my decease pay all Just demands charges and exactions against me or my estate out of my personal property Thirdly it is my will and desire and I do hereby give devise and bequeath unto my beloved wife Joanna for and during her natural life the use of one third part of all the Estate Real and personal that I may die seized or possessed of or that I may be entitled to giving to her the choise and Election of such third either of Real or personal Estate as She may make which provisors aforesaid made for my said wife is to be deemed and taken in lieu and l___ of all dower or claim on my Estate Fourthly it is my will and desire and I do hereby give devise and bequeath all the rest residue and remainder of the Estate real and personal that I may die seized or possessed of or entitled to my four children to wit my daughter Betsy wife of William ALLEN Esquire and my Sons Henry, Samuel and Peter their heirs and assigns forever in manner following and under the regulations and restrictions hereinafter expressed that is to Say to my daughter Betsy one equal undivided Seventh part of all my Estate real and personal and to each of my said sons two equal undivided seventh parts of all my Estate without regard to any advances heretofore made or hereinafter to be made by me in my lifetime to any of them which division of my Estate it is my will and desire and I do hereby direct to be made as speedily as may be after my decease that is to Say first that my said wife and children their heirs or assigns sit down and agree in writing what shall be regarded as the Estate portion or dower of my said wife and then that my said four children their heirs or assigns in like manner agree among themselves on the partition and division among themselves of my Said Estate real and personal in the proportions aforesaid except the personal Estate elected and chosen by my Said wife which is not to be divided till her deceased and then divided in proportions as aforesaid_ and it is my further will and I do hereby direct that if by reason of any disagreement between my Said wife and children as to her Estate or between my Said children their heirs or assigns as to their portions of my Estate & her & dower is not assigned as aforesaid or they fail or neglect to agree on and make a division for the Space of six calendar months after my decease or if by reason of the death of either of my said children leaving infant heirs in either case it is my will and desire and for that purpose I do hereby direct authorize and impower my said Executors or the survivors of them by an instrument in writing under his or their hands and seals acknowledged as deeds usually are and worded in the Clerks office of this County to designate lay off Set apart and assign to my Said wife her share or to my said children their heirs or assigns forever his her or their share of my said Estate which shall forever be binding and Conclusive on them their heirs and assigns forever in all counts of Law and Equity And whereas I have agreed with my Son Peter who now lives with me to have the Sole and entire use benefit and advantage of all my real and personal Estate during my life or so long as he performs and fulfils the following conditions and provisions and no longer which conditions and Provisions are there that he Shall keep my real Estate in as good repair as it is now in and pay all taxes and assessments thereon as well ordinary or Extraordinary and keep maintain and in all & ____ ____ Support me and my said wife during my life with food _____ ______ attendance and all and every other necessary and convenience that use may ask or desire and in case he fulfils Said Conditions and provisions (which he is to be demmand as having done unless my dissent is expressed in writing) at my decease Said Peter is not to account or pay over to my Executors or heirs any profits or advantages arising from Said person nor to deliver up any farming utensils But is to deliver to my Executors Two hundred twenty two dollars and fifty cents worth of horses_ Eighty two dollars worth of horned cattle Twenty four dollars worth of sheep Seven hundred pounds of live hogs or pay the value in Cash and deliver thirty dollars worth of farming utensils or So much in money in his election and if Said Peter fails to deliver and pay said Executors as aforesaid my Executors are to deduct it out of his share of my Estate____ If said Peter erects any new buildings on the farm he is to be allowed for it_ In Witness
