Sampson County, NC - Wills - Solomon R. Daughtry,1893 Will of Solomon R. Daughtry, 1893 I, S.R. Daughtry of Sampson County State of N.C. being of sound and disposing mind and memory, do make and declare this to be my last will and testament, hereby revoking all former wills by me heretofore made. And as to my worldly estate, and all the property, real, personal, or mixed, of which I shall die seized or possessed or to which I shall be entitled at the time of my decease I devise and dispose of in the following manner, to wit. My will is, that all my Just debts and funeral expenses shall by my executor herein after named be paid out of my estate, as soon after my decease as shall by them be found Convenient. I give and bequeath to my wife, all my house hold and kitchen furnature, one mare by the name of "Puss", two cows and calves, two sows and pigs, all the provision on hand. I will and bequeath to my wife 125 acres of land including my dwellings, until my youngest son, Solomon Eugene shall become of age; then to him as his part of my real estate, but when he shall become of age, it shall be the home of my wife and he shall have no right of transfer during her natural life or widowhood, the line to begin at the Canal and runs with the line to my back line and up the Canal as it meanders including my dwellings on the South east side of said lane; also I will and bequeath to my son Solomon Eugene fifty dollars in money toward buying a horse. I will and bequeath to my wife one horse cart, harness and farming tools for a one horse farm, her choice. I will and bequeath to my son Ed Howard 135 acres of land lying on the North west side of the lane including the house that John Stevens lives in, also fifty dollars in money to help in buying him a horse. I will and bequeath to my son James Bryan 135 acres of land, joining the lands of W.H. Boyett and Wm R. King, the 135 acres to include one half of the open land on the west side of the Swamp, also one mare ("Modest.") I will and bequeath to my son George L., 135 acres of land joining the land given to my son James, the 135 acres of land to include one half of the open land lying on the west side of the Swamp, also one horse colt, name charlie. I will and bequeath to my daughters, Mary F. Futrell, Nancy E. Parker, Della C. Weeks, Tempia A. Daughtry, Zilphia A. Daughtry and Lilla M. Daughtry, two hundred dollars, each in money, provided there is that much left of my estate. To my daughter Lillie I give fifty dollars in money extra to be used in sending her to school. It is my will and desire that my real estate be kept in my family and together as I have designated, but should anyone of my children desire to sell or dispose of their part, the transfer shall be made only to a brother or sister by blood. It is my will and desire that my sons pay to my wife each and every year during her natural life or widowhood the customary rent on all the land under cultivation. All the rest and residue of my estate, real, personal and mixed, of which I shall die seized & possessed, or to which I shall be entitled at my decease I give and bequeath to be equally divided among my six daughters- Mary F. Futrell, Nancy E. Parker, Della C. Weeks, Tempia A. Daughtry, Zilphia A. Daughtry and Lillie M. Daughtry. And, lastly, I do nominate and appoint my son James Bryan Daughtry to be the lawful executor of this my last will and testament. In witness whereof, I, S.R. In the Superior Court Sampson County } A paper purporting to be the last Will and Testament of S.R. Daughtry deceased, is exhibited before me, the undersigned Clerk of the Superior Court for said County, by James B. Daughtry, the executor therein mentioned, and the due execution thereof by the said S.R. Daughtry by oath and examination of J.D. Ezzell and W.T. Sutton witnesses thereto; who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper-writing now shown him, purporting to be the last Will and Testament of S.R. Daughtry that the said S.R. Daughtry in the presence of this deponent subscribed his name at the end of said paper-writing; which is now shown as aforesaid, and which bears date of the 19th day of August, 1893. And the deponent further saith, That the said S.R. Daughtry the testator aforesaid, did at the time of subscribing his name as aforesaid declare the said paper-writing so subscribed by him, and exhibited to be his last Will and Testament, and this deponent did thereupon subscribed his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent's subscribing his name as an attesting witness thereto, as aforesaid, the said S.R. Daughtry was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not.
