This Indenture made this 17th day of January, in the year of our Lord 1825 Between Abraham Hanes Nancy Wallace by his agent both of the County, of Williamston & State of Tennessee Needham Thornton by his agent & John Hanes both of the County of Rutherford & State of Tennessee Robert Fortner & his wife Henrietta Fortner of the County of Wayne & Lewis Wiggins and his wife Rachel all of the State of North Carolina of the one part and Joseph Sutton of said State and County aforesaid (Sampson N. Carolina) of the other part Witnesseth that we the said Abraham Hanes Nancy Wallace Needham Thornton by our agent Abraham Hanes John Hanes Robert Fortner & his wife Henrietta Fortner & Lewis Wiggins & his wife Rachel and in consideration of the sum of one hundred & fifty dollars to us in our hand paid by the said Joseph Sutton before the Sealing and delivering of other presents have bargained & Solde Conveyed & Confirmed unto the said Joseph Sutton his heirs and assigns forever Six Certain Lots ___- or parcels of Land in the County aforesaid on the South side of Goshen Swamp it being our perpotional parts of of the Lands of John Hanes Senr. late of the County of Sampson deceased Containing 405 Acres it being the whole amount of the Land of the said deceased undivided which were partitioned is one half of the Real Estate of the said deceased to have & to hold the above Bargained Land and premises with all and singular the appurtenances thereunto belonging or in any wise appertaining unto the said Joseph Sutton his heirs and assigns forever and The Said Abraham Hanes for my self & Nancy Wallace Needham Thornton John Hanes Robert Fortner & his wife Henrietta Lewis Wiggins & his wife Rachel for ourselves our heirs our admins. Do Covenant agree to and with the said Joseph Sutton his heirs & assigns to warrant and forever defend the above bargained lots of Lands with their premises in fee simple, In Witness whereof we have here unto set our hands and affirm our Seals the day and year above writing the words Robert Fortner & his wife interlined before assigned ----Signed Sealed & delivered in presence of us Abraham Hanes (Seal) Ben Phillips saw 2 sign for Self Nancy Wallace & Needham Thornton Tha Sutton John X Hanes (Seal) his mark Tho.
