I, James Foyle Senr., Of the county of Onslow and State of North Carolina being sound in mind & memory blessed by god for all his mercies knowing the certainty of death but not knowing when it may happen, I do make this my last will & testament in the manner following Viz.(?) I give to my beloved wife Martha Foyle two negroes by a woman by the name of Chelcea & a boy by the name of Alfred, to her & her heirs to have & to hold forever; I also give to my beloved wife Martha, one young man by the name of Gin (?), one side saddle & bridle, one feather bed & furniture, two cows & calves, two three year old steers, the whole of my stock of hogs, twenty barrels of corn, one pot, one tea kettle, one large oven (Dutch) all the crockery ware & pewter ware, three setting chairs, & one large trunk, & two spinning wheels to her & hers forever. Likewise I leave to my beloved wife Martha the plantation whereon I now live together with all the land attached to it during her lifetime. I leave to her also all my farming utensils during her lifetime. I also lend to my wife Martha our bed & furniture during her lifetime & after her death the bed is to be sold & the money divided among my heirs as shall be named hereafter. I give to my grandson James Foyle the plantation whereon I now live after the death of my wife Martha Foyle together with such farming utensils as may be found on the (illegible) (the grave yard reserved containing half an acre) to him & his heirs forever. I give to my grand son Jesse Webb the land that I bought from Skipper & on which Thomas Prescott now lives & two young heifers to him & his heirs forever. I give to my son Hardy Foyle one dollar current money to be paid him out of my estate, I also give my son Hardy Foyle a judgment that I hold against him for twenty dollars in the hands of Charney Sparkman to him & his heirs forever. I give to my son in law Fred (?) Prescott one dollar current money to be pd to him out of my Estate. I give to my grand son Ivy Foyle one dollar in current money to be paid to him out of my Estate. I give to my grandson Obed Scott one dollar in current money to be paid to him out of my Estate. I give to my grand daughter Kitty Foyle one dollar current money to be paid to her out of my estate. I give to my grand daughter Mary Foyle one dollar to be paid to her in current money out of my Estate. I give to my grand daughter Betsey Foyle one dollar to be paid to her in current money out of my Estate. I give to my grand daughter Pena Foyle one dollar current money to be paid to her out of my Estate. I give to my grand daughter Charity Webb one dollar current money to be paid to her out of my Estate. I lend to my daughter Sally Prescott two cows & calves together with their increase during her life time. I also lend to my daughter Sally Prescot one bed & furniture, one large chest and one tea kettle. The last named articles are now in her possession and after her death all the property lent my daughter Sally is to be sold as a part of my Estate. The balance of my stock of cattle after those given my wife Martha & those given to my grand son Jesse Webb, and those lent to my daughter Sally Prescot, are taken out, I leave to be sold together with one horse & one man by the name of Will (?) & some other articles too tedious to mention. All the money arising from the sale of my estate (by that part of my estate not given away), after the settlement of the legacies as named above, I leave to be divided between my wife Martha Foyle & my grand sons Jesse Webb, William Webb, Willis Webb, Henry Foyle & Daniel Foyle in the manner following. Jesse Webb is to receive ten dollars extra & one equal proportion with my wife Martha & the rest of my grand sons, William & Willis Webb & Henry & Daniel Foyle to them & their heirs forever. I hereby nominate & appoint my trusty friend John A. Avirett of the above named county & state executor to this my last will & testament revoking all heretofore made in witness whereof I hereunto set my hand & seal this the 20th day of October in the year of our lord one thousand eight hundred & twenty seven. Avirett qualified State of North Carolina, Onslow County, In open court Feby. Term 1828, this will was proved by the oaths of John B. Smith and Asa H. Rhodes, the two subscribing witnesses & John A.
