Wayne County, NC - Deed - Nancy J., J.R. and Sarah Hodges to Thomas J. Hill, 1873 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Lenoir County Indenture - 1873 Nancy J., J.R. and Sarah Hodges to Thomas J. Hill This indenture made and executed this the twenty second day of December A.D. one thousand eight hundred and seventy three between Nancy J. Hodges, J.R. Hodges and Sarah Hodges of the county of Lenoir and state of North Carolina of the first part and Thos. J. Hill of the county and state afore said of the second part witnesseth that the said Nancy J., J. R. and Sarah Hodges for and in consideration of the sum of five hundred Dollars to them in hand paid the receipts and payment where of is hereby acknowledge hath bargained granted and sold and by these presents doth grant bargain sell confirm and convey to the said Thos. J. Hill a certain tract or parcel of land located in the county aforesaid on both sides of the A. & N.C. R.R. adjoining the lands of Louis C. Desmond deceased Thos. J. Hill and others bounded as follows; beginning at the Hills & Hodges corner known as the Potts corner and runs North 70 East two poles to alightwood stake near a green pine then with the various courses of the Rayner ditch as follows; S4? E 113 poles to A. & N.C. R.R. then SE 47 poles to the mouth of said ditch then with Louis C. Desmond dec'd line to Thomas J. Hill line then with the said Thomas J. Hills line to the beginning containing ten acres more or less to have and to hold the above described tract of land to the said Thos. J. Hill his heirs and assigns forever and we the said N.J., J.R. and Sarah Hodges for ourselves our heirs and assigns do warrant and forever defend the title of said lands free and clear from the claim or claims and incumbrances of all persons what so ever in testimony where of we have here unto set our hands and seals the day and date above witness. Hill LENOIR COUNTY --- IN THE PROBATE COURT Be it Remembered, That on the 22nd day of December, 1873, before the undersigned Judge of Probate for said County, personally came Nancy J. Hodges and James R. Hodges and Sarah Hodges his wife, the persons described in, and who signed, the fore going Deed, and acknowledged the due execution thereof by them as their act and deed.---And thereupon the said Sarah Hodges being by the undersigned privately examined separate and apart from her said husband, touching her free consent in the execution thereof, doth declare, on such her examination, that she had executed the same freely, of her own will and accord, and without any force, fear or undue influence of her said husband or any other person, and did still voluntarily assent thereto.
