Atkins, dated 26 Nov 1842; proved Dec 1842 Transcribed from copy received from NC State Archives State of North Carolina November 26, 1842 In the name of God Amen! I George B. Atkins of the Town of Fayetteville in the county of Cumberland and State of North Carolina being of sound and disposing mind and memory but sensible of the uncertainty of this life do make and publish this as my last Will and Testament hereby revoking all others heretofore by me made. Item1. I desire my body to be decently interred, and all necessary expenditures to be made in regard thereto in the event of my demise. 2. I desire all my just debts to be paid - and after the payment of my debts - I desire and bequeath all my property of every description whatever both real and personal to my beloved wife - Mary and my children begotten on my said wife. [blank space] to be equally divided between them share and share alike; and in the event of the death of either my wife or any of my children my desire is that the share accruing or belonging to the said child or any of them or my wife dying should be divided equally amongst those surviving. 3 rd And whereas I have considerable interest in the partnership in the town aforesaid conducted under the firm and style of J. C. & G. B. Atkins and am anxious that my death should not embarrass the business of said firm or occasion its immediate dissolution- I hereby qualify the above second clause of this my will and desire & bequeath all the goods - property - debts - notes & accounts of said mercantile firm in which I am interested and all my interest in said partnership unto my Brother John C. Atkins one of the partners of the aforesaid firm in trust however for the benefit of my wife and children- which said trust is to expire at the end of two years after my death - It being my desire that my brother John C. Atkins Trustee aforesaid should have the full power to use my name for two years after my death by signing the name of the firm aforesaid in the renewal of all notes at present existing and to sign the name of said firm in any way for the benefit of said firm and for the purpose of closing up the business of the same and not for any other purpose whatever. - the said power and authority of using my name as aforesaid to expire at the end of two years after my death. 3. My wish & desire is that at the end of two years after my death my brother John C. Atkins should entirely close the business of the firm aforesaid and pay over all mony and deliver over all notes and property of every description belonging to me as one of the partners aforesaid and all my share of said partnership after paying the debts of the same - unto my friend John H. Hall Senior for the benefit of my wife and children each taking share and share alike It is further my desire - and the above devise to my brother is hereby qualified & explained that my brother should as rapidly as possible pay over my share of the firm aforesaid to my friend and executor John H. Hall Senior - and that he J.C. Atkins should out of the stock-goods & money of said firm deliver and pay over to my executor John H. Hall Senior all goods - monies and other articles necessary for the support, education & comfort of my family for the next two years after my death Having all confidence in the integrity and capacity of my friend John H. Hall Senior I do hereby appoint him my Executor of this my Last Will and Testament to carry out the herefores of my will and divide my property equally share and share alike between my wife and children which I desire to be theirs in fee simple forever.
