I give derive and bequeath my estate and property real and personal as follows, that is to say. I want as soon as practicable and my children think best after my death. my farm on which I now live and one half of twenty-two and one half acres of undivided land owned by me and my brother Leyman Kurtz lying on the waters of Cox's Creek Nelson County Ky sold to the highest and best bidder. I also want all of my personal property sold to the highest and best bidder and after all of my debts are paid. I want a good common tombstone put to the grave of my wife Ann E. Kurtz and one to the grave of George F. Kurtz and one to the grave of Mary A McGaha and also to my grave. I want the remainder of the proceeds of any real and personal property divided equal among all of my children and my grand child Lizie Bell McGaha now living in Texas who is an infant and if Lizie Bell McGaha dies without children I want all she gets from my estate to be divided equal among my children. I appoint John W Kurtz and Thomas W. Watts executors of this will. In witness where of I have signed sealed and published and declared this indenture as my last will at home on this January 22 nd 1883. Mathew Kurtz The said Mathew Kurtz at said place on said day signed and sealed this instrument and published and declared the same as and for his last will and we at his request and in his presence and in the presence of each other hereunto written our names as subscribing witnesses Marshall Miller Wm B Hessey State of Kentucky, October Term Nelson County Court Oct. 8, 1894 The foregoing paper purporting to be the last will and testiment of Mathew Kurtz deceased. late of this Nelson County Ky was this day produced in open court and duly proven by the oath of W. B. Hessey one of the subscribing witnesses there to who also moved the attestation of Marshall Miller the other subscribing witness thereto who signed same in each other presence in the presence of and at the request of testaton where on said paper was recorded as the last will and testament of Mathew Kurtz which is done.
