CLARK COUNTY, INDIANA DEEDS Book 39, p. 583 This Indenture made this 26th day of February A D 1848 between Robison S. Summers and Emaretta M. Summers his wife formerly Emaretta Breeden William O. Williams and Mildred S. Williams his wife who also was Mildred S. Breeden and heirs at law & legal representatives of James Breeden late of the County of Clark and State of Indiana deceased, parties of the first part And Calvin C. Breeden of the Second part all of the County of Clark and State of Indiana. Witnesseth, that the Said parties of the first part for and in consideration of the Sum of three hundred and Seventy five Dollars Current money of the United States to the Said parties of the first part by the party of the second part in hand paid the receipt is hereby acknowledged have granted bargained and Sold and by these presents do grant bargain alien Sell Convey and Confirm unto the Said party of the Second part his heirs and assigns forever All of the following described piece or parcel of land to wit being the Equal and undivided two eighths or one fourth part of one hundred and Eighty Seven acres 2 rods & 22 poles of land being part of a Survey numbered one hundred and fifty eight (158) on the map or plat of the Illinois Grant in County of (p. 584) Clark and State of Indiana and the Same tract of land conveyed by Elias Long & wife to Said James Breeden by Deed dated on the 8th July 1840 which Deed is recorded in the Recorders Office of Clark County Indiana Book F, Vol. 2nd No. 33 on pages 362, 363, & 364 and for a more full description of Said land reference is had to Said Deed which Said land the Said James Breeden died Seized leaving a widow and 8 children his heirs &C. To have and to hold all and Singular the Said Equal undivided two eighths parts or 4th part of the land above described together with all the rights members privileges hereditaments and appurtenances and all the Estate right title interest Claim and demand whatsoever of them the Said party of the first part Either in law or Equity of in and to the premises aforesaid unto him the said Calvin C. Breeden his heirs and assigns to his and their only proper use benefit and behoof forever And the Said parties of the first part for themselves their heirs Executors and Administrators do Covenant with the Said party of the Second part and his heirs and assigns that they are lawfully Seized in fee of the premises as aforesaid that the Same is free from incumbrance and that they will warrant and for ever Defend the Same and the quiet and peaceable possession thereof together with the appurtenances to the Same belonging or appertaining unto the Said party of the Second part and his heirs and assigns against the lawful Claims of all persons whomsoever. Excepting only the Dower right of Catharine Breeden widow of Said James Breeden Decd which She is to have for and during her natural life &the foregoing Deed is Subject to Sd Dower right. Also a Lein is given by the party of the Second part and retained by the parties of the first part on the land Sold & Conveyed in the above and foregoing Deed to Secure the payments of Six Several notes or writings obligatory of even date with the foregoing Deed one give by said Calvin C. Breeden for $62.50 ct payable to William O. Williams or order on or before the 1st Jany 1849, and one to Same for $62.50 ct due & payable on or before the 1stJany 1850 and one given by Sd C. C. Breeden for $49.75 ct payable to Robison S. Summers or order on or before the 1st Jany 1849 and one from Same to Same last above mentioned for $50. due 1st January 1850 & one from Same to Same Last mentioned for $50. Due 1st January 1851 and one from Same to Same last above mentioned for $50. Due and payable 1st January 1852 amounting in the whole to $324.75 cts. In testimony whereof the Said parties of the first part have hereto Set their hands and Seals the day and year first written within. Summers & Ameretta M. Summers his wife. William O. Williams & Mildred S. Williams his wife the grantors named in the above and within Instrument of writing and Severally acknowledged the Same to be their voluntary act & Deed for the purposes therein Expressed. The Said Emaretta M. Summers & Mildred S. Williams being Each by me Examined privately Separate & apart from & without the hearing of their Said husbands and the Contents & purport of the Said Deed by me fully made known to Each of them they Each acknowledged that they Executed the Said Deed of their own free will and accord and without any Coercion or Compulsion from their Said respective husbands.
