After all my just debts are fully paid, first I will and bequeath to my beloved wife Jane Bacus all my personal property of every description. Also all the money I have on hand together with all notes and mortgages I hold for the payment of money during her natural life or widowhood to be disposed of as hereafter stated. My will and desire is that when my boys or any of them become of age that my said wife should divide my estate with them in _____ of advancement as she may think just and right. And further my desire is that if my said wife should marry again then my said estate be equally divided between my children. And further my desire is that if my beloved wife should die without marrying then all my estate of every description remaining not expended shall be sold and equally divided between my children. And lastly my will is that my beloved wife Jane Bacus be appointed my Executrix and having full confidence in her honesty and integrity and that she will not be required to give bond and security as such Executrix this November 11th day. Smith James L. Elliott State of Illinois Massac County In the County Court of said County in probate November Term A. D. 1865. Personally appeared in open court Elijah Smith and James L. Elliott Subscribing Witnesses to the foregoing instrument of writing purporting to be the Last Will and Testament of Issac Bacus late of Massac County deceased who being duly sworn according to Law does depose and say each for himself that the foregoing is the Last Will and Testament of the said Isaac Bacus deceased. That he subscribed his name thereto as the attesting Witness at the request of the said Testator and in his presence and in the presence of each other on the 11th day of November A. D. 1865. That he then and there subscribed his name thereto in his presence and declared the same to be his Last Will and Testament and that the said Testator at the time of executing the same as aforesaid was of full age of sound mind and memory and under no constraint.
