Pertinent parts of the Will were set forth in the book "Francis Gaines of Albermarle Co., VA and Elbert Co., GA" by Dr. Thomas R. Gaines of Anderson, SC., as follows: "I, Francis Gaines.......as for my Worldly Estate wherewith God has Blessed me in this life, I leave and bequeath as follows, viz. In the first place I ordain and appoint all my just debts to be paid, and Secondly all my other property real and personal except my Shot Gun. "To my Beloved Wife, Judy Gaines, dureing her life to be intirely without controul of Division and at her death to be Equally divided among my children to-wit: R. T. Gaines, Polly Henderson, Richard S. Gaines, William Crawford, Sally McMullin, Dureing her life and at her death for the Real use of her heirs that is to say her children, and Judy Barnett Gaines, Mary Elizabeth Gaines, Livingston P.Gaines Deceased Children, and to Francis Gaines, Junr. the above named shot gun. Also my Draws of Land in the Ensuing Lottery and I do appoint and nominate R. T. Gaines, William Crawford and Richard E. Gaines Administrators of this my Last Will and Testament Revoaking all others. In Witness Whereof, I have hereunto set my hand and affixed my Seal this 12th day of October, 1825. His Francis X Gaines (L.S.) Mark" The Will was witnessed by Richard Harper, John Cunningham and James B. Alexander who also proved the Will in Open Court on 7 Nov 1825. The Will was recorded on 8 Nov 1825 by Job Weston, Clerk of the Court of Ordinary of Elbert Co.
