Lambert Estate of } this day Itis ordered that the said Elizabeth J. Lambert be and she is hereby appointed administratrix of said estate and that she give bond in the sum of five thusand dollars. Ordered that the bond this day filed by Elizabeth J. Lambert as such administratrix as afore said in the sum of Five thousand dollars with H M. Lambert and Isaac Thompson as her securities be and the same is hereby approved and that letters of administration issue to her accordingly. It is further ordered that Thomas Howard A.M. Lambert and A. Lambert at the time of his death in certain land particularly described in said petition that the said Elias Lambert deceased left surviving him your petitioner the widow of said decedent & four children, to wit: Ellen, Jehew, Ruth & M. deLafayett Lambert all of whom are minors & reside in Monroe County Ala, and praying for an order to have said lands partitioned between the said A.M. Lambert & the aforesaid widow & children. It is therefore ordered that the 4th Monday of December next be appointed for the hearing of said petition. It is further ordered that J.F. Lambert, the admrix of said estate, the same having been appointed, by continuence, for hearing her petition for a division of the land belonging to said estate and A. M. Lambert, among said joint owners and the notice required by a previous order of Court having been given to all the parties intercoted by citations personally served on them- also came J. F. McCorvey who was heretofore appointed gdn al litem for the minors interested, and who filed his answer in writing denying the allegations contained in said petition, and demanding the proof- And it appearing to the satisfaction of the Court from the written testamony James Thames and John Moore, which is filed of record in this proceeding that the allegations contained in said petition are true; that the following described lands which are held and owned jointly by the estate of Elias Lambert, decd and A.M. Lambert, to wit: The NW 1/4 of Sec 31;- The NE 1/2 of Sec 36; and the NE 1/4 of SE 1/4 of Sec 25, T6 R5.- The W 1/2 of NE 1/4 Sec 31;- E 1/2 of NE 14 Sec 31; - N1/2 of SE 1/4 Sec 31;-NW 1/4 of Sec31;- and SW 1/2 of Sec 30 T6 R6.- The NW 1/4 of Sec 36;- E 1/2 of NE 1/4 Sec 35;- SW 1/4 of SW 1/4 Sec 36:- NW 1/2 of SW 1/4 Sec 36;- SE 1/4 of SE 1/4 Sec 36;- E 1/2 of SW 1/4 Sec 36;- W 1/2 of SE 1/4 Sec 36;- and W 1/2 of SE 1/4 Sec 25, T6 R5;- The SW 1/4 of Sec 32;- W 1/2 of SW 1/2 Sec 29;- SE 1/4 of SW 1/4 Sec 29;- NE 1/4 of NW 1/2 Sec 32;- SW 1/4 of NW 1/4 Sec 32;- NE 1/4 of SE 1/4 Sec 30; SE 1/4 of NW 1/4 Sec 32;- and SE 1/4 of SE 1/4 sec 30 T6 R6;- and the E 1/2 of SW 1/4 Sec 25 T6R5 can be equitable and fairly divided without sale thereof, and that it would be beneficial to the interest of the parties, that said division should be made: It is therefore ordered, adjudged and decreeed by the Court that the prayer of said petition be granted. It is further ordered that John L. Marshall, W. J. Robison, Andrew Barton, John Moore, and T. J. Carter be adn they are hereby appointed commissioners to ? off and make division of said land between the Estate of Elias Lambert, decd and A.M. Lambert, giving to each one half interest in said lands after first having taken an oath to make the same fairly and impartially, and that they make due return of their preceeding in the premises on or before the second Monday of January next. It is hereby ordered that said petition be recorded & held on file.
